Road Traffic Offences Withdrawn

Published - Jul 29, 2022

Foster & Coleman recently acted for a young client in relation to youth court proceedings for a number of road traffic matters. Counsel attended to represent our client at the first appearance and following representations to the Prosecutor and representative from the Youth Offending Team (YOT) it was agreed that the matters were suitable for an out of court disposal. The case was adjourned as a result. The local police and YOT subsequently refused to deal with the matter citing ‘protocol’ which had been agreed with the CPS. Despite extensive representations by Foster & Coleman, the matter was referred back to court. Counsel attended on the next occasion and discussed the matter at length with the Prosecutor, who confirmed that they were unaware of any such ‘protocol’. After seeking advice, they returned to court and confirmed that they would be withdrawing all matters against our client.

Our client and his family were incredibly grateful and relieved and sent the following feedback to us:

‘I am absolutely delighted with the outcome of the subject matter, which as a concerned and worried parent was managed with great care from the very first phone call.

Your advice on the matter from the outset was precise and knowledgeable, you provided great comfort in relation to the next steps from start to end. The fees quoted were very reasonable in comparison to the other lawyers that I had contacted in the Bromley area.

The reason I chose you was because, on the first call, you demonstrated a strong approach that focussed on the best remedy for the charged offences.

You managed the pre-hearing disclosures from the police very well and most importantly appointed an extremely capable Barrister from a team of Barristers that you work with. The Barristers were very well versed with the law and in fact on the day of the hearing pointed out to the prosecution at the Youth Court, which penalties the law provided in relation to such motoring offenses and managed to negotiate an out of court assessment that eventually led to the dismissal of the offences! The verdict however did not arrive without resistance from the Police who wanted to see the matter prosecuted but again your appointed Barrister at the second hearing pointed out to the court the breakdown in procedure between the Police and the Youth Offending Team that made the prosecutor assess the matter that provided a fair dismissal.

Both my son and I are very grateful for your service and will definitely recommend you should anyone ask us.’
