Steve Foster recently acted for a client who was tried and rightly acquitted of an offence of Rape.
Having attended the police station for a voluntary interview in early 2019, during which the allegation was categorically denied, the matter was eventually listed for trial at the end of 2022. Throughout that time the defence had repeatedly submitted to the prosecution that there was insufficient evidence with which to provide a realistic prospect of a conviction, and that the information they continued to disclose in fact indicated that the complainant was lying about the incident. These representations were continually disregarded, and the prosecution confirmed their intention to proceed.
Following three days of legal argument and mid-way through cross-examination of the complainant, the prosecution made the sensible decision to offer no evidence, and the defendant was acquitted.
