Another Driving Disqualification Avoided

Foster & Coleman recently acted for a client facing a penalty points disqualification following an earlier guilty plea to an offence of using mobile phone whilst driving.

The case was listed for sentence, during which we submitted that any disqualification following the imposition of the appropriate penalty points would result in 'exceptional hardship'. Thorough preparation allowed for numerous supporting statements and evidence being provided to the Court from colleagues, business associates, and clients. This evidence clearly demonstrated that the hardship would be suffered not only by our client and his young family, but also those with whom he worked with and for.

Following a short deliberation the Court agreed that 'exceptional hardship' had been established and did not to disqualify, imposing penalty points.
