Fail to Provide Proceedings Discontinued

Foster & Coleman recently acted for a client due to stand trial for an allegation of failing to provide a specimen of urine at the police station.

Prior to trial a number of statements and documents were requested from the prosecution, which we believed would support our clients’ assertions that he was incapable of providing the required specimen rather than unwilling. The disclosure requests were repeatedly ignored until the issue of wasted costs was raised should the information not be provided to us in advance of the trial. This appeared to prompt a full review by the prosecutor of the information requested, which lead to the decision to discontinue the proceedings.

Our client was rightfully acquitted, and thoroughly delighted.
